1. Acceptance of Terms

2. Emergency Dispatch & Scope of Services

All emergency dispatch timelines are estimated based on weather conditions, traffic, and technician availability. While our crews make every reasonable effort to arrive within 45 to 60 minutes, dispatch times are not contractually guaranteed.

3. Work Authorizations & Moisture Mitigation

Before beginning emergency extraction or structural drying, the property owner, authorized representative, or tenant must execute an initial Work Authorization and Direct Payment Agreement. This authorization grants our technicians permission to:

• Enter the premises and deploy diagnostic equipment (moisture meters, thermal cameras).
• Extract standing water, remove saturated non-restorable materials (such as contaminated carpet pad or ruined drywall), and treat surfaces with antimicrobial solutions.
• Place commercial LGR dehumidifiers, air scrubbers, and high-velocity air movers to establish a balanced drying environment.

4. Property Access & Occupant Safety

The client agrees to provide safe and unimpeded access to all affected areas of the property for the duration of the project. Property owners are responsible for securing domestic pets, removing valuable or fragile personal belongings from work zones, and notifying our crew of any known structural, electrical, or environmental hazards (such as asbestos, lead paint, or live electrical lines near standing water).

5. Payment Terms & Insurance Billing

Payment terms are established as follows:

• Insurance Covered Losses: When authorized, we bill insurance carriers directly using industry-standard pricing software (Xactimate®). However, the property owner remains ultimately responsible for the policy deductible, any non-covered items, or balances denied by the insurer.
• Direct / Self-Pay Projects: A deposit is required prior to equipment setup, with the final balance due upon completion of structural drying and receipt of the Certificate of Satisfaction.
• Late Payments: Balances unpaid past thirty (30) days from invoice date may accrue interest at the maximum rate permitted under Texas law.

6. Limitation of Liability

Water Damage McKinney TX and its technicians adhere to industry standards (including IICRC S500 guidelines). However, our liability is limited as follows:

• We are not liable for pre-existing property defects, prior unmitigated moisture, foundation settling, or hidden structural decay.
• We are not responsible for secondary damage or microbial amplification occurring prior to our arrival or resulting from client tampering with or premature shutdown of drying equipment.

7. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Collin County, Texas.
